General Process Flow:

To obtain the request for approval form, go to FRONTSTEPS (available in 3Q) and log in your account. For those of you who do not have an account and choose to not sign up for one, then reach out to Toney Dionne (901-758-5678 or toney.dionne@crye-leike.com) and Brooks Stevenson (brooks.stevenson@crye-leike.com) to have a form emailed to you.

Complete the form and submit it to Toney Dionne and Brooks Stevenson. Include any necessary details (sketches, etc.) and pictures (if applicable) with your submission. Crye-Leike PM will check it for completeness before forwarding to the ARC.

The ARC will review the submission and may or may not need to reach out to the homeowner during its review for additional information or clarification.

The ARC will notify the homeowner on its decision within 30 days. In most cases, it will be a much quicker turnaround (48-72 hours), especially in the case of painting the exterior of the home using original colors.

Important Points to Remember:

All existing exterior colors on the home including fence colors and front door colors shall be grandfathered in as of March 23, 2025, i.e. the date that the new board of directors assumed control of the HOA from the developer.

Landscaping pertains primarily to areas outside the homeowner’s fenced-in backyard.

Tree, shrub and flower planting do not apply to existing beds at the front of the house, provided homeowners understand what they’re doing when replacing / re-planting / planting such vegetation in terms of spatial requirements and general aesthetics. Should a homeowner need advice, the ARC will be more than happy to offer it.

No planting of any kind is allowed in the grassy area between the street curb and sidewalk.

ARTICLE VI, Section 7 Fence

No fence shall be erected without the approval of the Architectural Review Committee (ARC). The ARC shall also approve all locations, design and materials, with respect to all fences. Fencing shall not extend past the front of any home into the front yard setback.

ARTICLE VI, Section 8 Window Treatment

Window treatment installed within the home shall be completed so that the only color that may be visible from the exterior of any home is a white or off-white color. All window treatments must have a neat and professional appearance from the exterior of the structure.

ARTICLE VIII Architectural Review, Section 2 Approvals Necessary, Rules of Committee & Remedies For Violation

…no structure of any kind or nature or any fence or barrier shall be commenced, erected, placed, moved onto, or permitted to remain on any of the Lots within the Development, nor shall any existing structure, fence or barrier upon any Lot be altered in any way which changes the exterior appearance (which includes but is not limited to changes in paint color and re-roofing) thereof, nor shall there be any additions, attachments, or deletions to improvements, nor shall there be any change in landscaping, without the written consent of the ARC. Such plans and specifications shall be in such form and shall contain such information as may be required by the ARC.

The ARC may promulgate rules governing the form and content of plans to be submitted for approval or requiring specific improvements on the Lots including, without limitation, the exterior lighting and planting and may issue statements of policy with respect to approval or disapproval of the architectural styles or details or other matters which may be presented for approval.

In the event the ARC fails to approve or disapprove any plans and specifications or other requests as herein provided within thirty (30) days after submission thereof, the same shall be deemed to have been approved, as submitted and no further action shall be required.

If any structure, fence, or barrier shall be altered, erected, placed or maintained (including exterior maintenance) upon any Lot or any new use commenced on any Lot, otherwise than in accordance with plans and specifications approved by the ARC as required herein, such alteration, erection, maintenance, or use shall be deemed to have been undertaken in violation of the restrictions herein and without the approval required herein, and upon written notice from the ARC, any such structure, fence or barrier so altered, erected, placed or maintained upon any Lot in violation hereof shall be removed or altered, and such use shall be terminated so as to extinguish such violation.
